Punição, retribuição e comunicação: contributo ao estudo da teoria da pena criminal

Abstract

O presente trabalho, vinculado à Linha de Pesquisa Sistemas Jurídico-Penais Contemporâneos, tem por objetivo analisar e estabelecer as bases para a compreensão do problema da punição criminal. Para tanto, pretende-se buscar um novo olhar sobre o tema, historicamente divido entre teorias preventivas e retributivas. Em primeiro lugar, busca-se o rigorismo nos conceitos trabalhados, assim evitando equívocos na análise do objeto em questão. Em segundo lugar, analisam-se as teorias retributivas oriundas da common law, dentre as quais desponta a teoria comunicativa de Duff, estudada no terceiro capítulo.

This work, linked to the Research Line of Legal-Penal Contemporary Systems, aims to examine and establish the basis for understanding the problem of criminal punishment. To this end, intends to seek a new perspective on the subject, historically divided between preventive and retributive theories. Firstly, seeks to be rigorist in the concepts used, thus avoiding mistakes in the analysis of the object in question. Secondly, analyzes the retributive theories derived of the common law, among which stands out Duff's communicative theory, studied in the third chapter.
