Direito de propriedade em comunidades Quilombolas: reconfiguração do conceito de propriedade privada no direito brasileiro?

Abstract

A propriedade quilombola está garantida pelo art. 68 do Ato das Disposições Constitucionais Transitórias. Apesar das discussões sobre sua aplicabilidade jurídica, sua dimensão civilística ainda não foi profundamente estudada, predominando estudos antropológicos e de direito público, especialmente em vista de nosso passado escravocrata e de seu legado à contemporaneidade. Trata-se, aqui, de desenvolver algumas questões sob o enfoque civil-constitucional acerca deste direito, de suas repercussões sobre o entendimento tradicional do instituto da propriedade, repersonalizado frente a valores constitucionais como o multiculturalismo, a dignidade da pessoa humana, as funções sociais da propriedade e da posse, dentre outros. Observa-se que tanto o regramento da Carta Magna quanto as disposições do Decreto n. 4. 887/2003 transformam, qualitativamente, o perfil iluminista e unitário desse instituto, impondo-se a indagação sobre a possibilidade de reconhecimento de estatutos proprietários diferenciados no atual sistema jurídico brasileiro. A importância da temática eleita para esta investigação também encontra-se demonstrada por ser o referido Decreto objeto de intensos debates acerca de sua eficácia jurídica no Supremo Tribunal Federal, em vista da Ação Direta de Insconstitucionalidade n. 3239.

The quilombola's property [black community inhabitant's property] is guaranteed by Art. 68 of the Transitory Constitutional Provisions Act. Although the discussions about its legal applicability, its civil appearance's size was not deeply studied, the anthropological studies and public law are predominant in this case, especially in view of our slavocratic past and its contemporary's legacy. We have, here, to develop some issues focused on civil and constitutional's law about this right, its impact on the traditional understanding of the property's institution, reshaping it against the constitutional values such as multiculturalism, person's dignity, social role of property and possession, like others. It's observed that both the rules the Federal Constitution as the Decree number 4. 887/2003 do the qualitatively transformation on that unitary profile of the property's institute, imposing inquire about the recognition possibility on different kinds of statutes owners in the Brazilian legal system. The importance of this theme, chosen for the present research, is also shown on because the 4887/03 Decree is a targeted object of intense debate about its legal effect on the Supreme Court [STF], in view of the Direct Action of unconstitutionality number 3239.
