Os procedimentos investigatórios e os direitos fundamentais do investigado

Abstract

A presente dissertação, vinculada à linha de pesquisa dos Sistemas Jurídicos Penais Contemporâneos, do Programa de Pós-Graduação em Ciências Criminais da Pontifícia Universidade Católica do Rio Grande do Sul, é uma pesquisa desenvolvida, cujo objetivo é discutir a aplicação efetiva dos princípios constitucionais inerentes ao Estado Democrático de Direito aos procedimentos investigatórios, em especial ao Inquérito Policial. Esse debate ocorre, tendo em vista a previsão legislativa do artigo 155 do Código de Processo Penal, que prevê a possibilidade de utilização de elementos informativos constantes no Inquérito Policial, para fundamentar a decisão condenatória, desde que não sejam utilizados de forma exclusiva. Nesse diapasão, tem-se também a problemática dos vereditos oriundos do Tribunal do Júri, no qual o jurado, pelo princípio da íntima convicção, está livre, para proferir decisão com base em qualquer elemento, seja ele processual ou informativo, sem a necessidade de qualquer espécie de fundamentação. Tais decisões, mascaradas no plano concreto, resultam em condenações, baseadas exclusivamente em elementos inquisitoriais, colhidos sem a observância do contraditório, em uma clara afronta às garantias que são asseguradas ao indivíduo pela Constituição Federal vigente.

The current dissertation, which is associated to the research line of Contemporary Legal Systems, in the Post-graduation Program of the Criminal Sciences of Pontifícia Universidade Católica do Rio Grande do Sul, is a research whose main objective is to discuss the application of the effective constitutional principles, which are in the Democratic State of Law as well as in to the Police Investigation. The debate occurs, considering the legislative that is established in the article 155 of the Code of Criminal Procedure that foresees the possibility of the utilization of the informative elements which are in the Police Investigation, in order to give the background to the condemnatory decision, but they should not be the center of the investigation. In this context, there are the issues that are observed in the Court Jury, in which the juror, taking into consideration the principle of the inner conviction, is free to decide, based on any element, either processual or informative, without any substantial proves. Those decisions, that might mask the true, can condemn a person, grounded exclusively on the inquisitorial elements that were collected without the observation of the contradictory, and it is an affront to the guarantees that are ensured to the citizens by current the Federal Constitution.
