Psicologia do testemunho: os riscos na inquirição de crianças

Abstract

A presente dissertação apresenta dois artigos, ambos versando sobre a inquirição ou entrevista forense de crianças. O primeiro artigo faz uma breve análise histórica da violência sexual contra crianças e dos movimentos que passaram a alertar para o problema. Considerando que a sociedade e o Estado ainda estão mais focados na punição do agressor que na proteção à vítima e diante da importância da palavra da vítima nos crimes contra a liberdade sexual, após revisão da literatura científica sobre sugestionabilidade e falsas memórias, analisaremos possíveis falhas na apuração da prova desse tipo de processo criminal, que podem contaminar a confiabilidade das declarações da vítima. O segundo artigo buscou revisar as pesquisas da Psicologia do Testemunho Infantil com o objetivo de identificar as melhores técnicas para a inquirição de crianças, relacionando os achados da literatura com os resultados de nosso estudo empírico. O delineamento do estudo busca uma validade ecológica ao tentar mimetizar as situações reais em que crianças são entrevistadas nas delegacias especializadas no atendimento de crianças e adolescentes.

This essay presents two articles, both of which debate on inquisition or forensic interview of Children. The first article does a brief historical analysis of sexual violence against children and the movements that have alerted to the problem. Considering that the society and the state are still focused more on the aggressor punishment than on the victim protection itself and face to the importance of the word ‘victim’ in crimes against sexual liberty, after revising the scientific literature about suggestibility and false memories, we will analyze possible failures in the verification of such criminal suits that may contaminate the reliability of the victim’s statement. The second article intends to revise the researches into infant testimonial psychology aiming an identification of better techniques to the inquisition of children, relating to what was found in the literature and the results of our empirical studies. The study lineation searches for an ecological legitimacy when trying to disguise the real situations in which children are interviewed in police departments specialised in children and adolescent care.
