A corporação como instância sociopolítica antecipadora do Estado na Filosofia do Direito de Hegel

Abstract

This essay discusses the concept of the Corporation, in Philosophy of Right published by Hegel in 1820/21, aiming to shed light on this issue. The hegelian concept of Corporation is considered a mediating institution, which is found in the Bourgeois Civil Society section. The importance of the concept is due the characteristics of social and political institution. This double feature prompted the question: How Corporations, taken as an instance of Civil Society-Bourgeois, treated by Hegel in the Philosophy of Law, perform the sociability that has the power to form "the interdependence and integration of individuals"? In order to give an answer, this essay was written in three chapters: 1) The institution of freedom in the Philosophy of Law, in which he sought to establish a connection between the Corporation and the central concept of the work: freedom, 2) Mediation of Corporations in bourgeois civil society, which is aimed to show the main elements that make up the corporation as an institution, and finally, 3) The Corporation between juridification and recognition, in which he sought to establish a hermeneutic reading of the current work and of that concept.

Esta dissertação aborda o conceito de Corporação, na obra Filosofia do Direito publicada por Hegel em 1820/21, com o objetivo de lançar luz sobre esta temática. Pois, a Corporação é considerada uma instituição mediadora, inserida na Sociedade Civil-Burguesa, cuja importância se deve, principalmente, pelas suas características de instituição social e política. Esta dupla característica motivou a seguinte pergunta: Como as Corporações, consideradas como uma instância da Sociedade Civil-Burguesa, tratadas por Hegel na Filosofia do Direito, efetuam a sociabilidade que tem a força de formar “a interdependência e a integração dos indivíduos”? Com o intuito de oferecer uma resposta, essa dissertação foi escrita em três capítulos: 1) A instituição da liberdade na Filosofia do Direito, no qual se buscou estabelecer uma conexão entre a Corporação e o conceito central da obra: a liberdade; 2) Mediação das Corporações na Sociedade Civil-Burguesa, no qual se buscou mostrar os principais elementos que compõem a Corporação, enquanto instituição; e, finalmente, 3) A Corporação entre a juridificação e o reconhecimento, no qual se buscou estabelecer uma leitura hermenêutica atual da obra e desse conceito.
