| Abstract: | This paper has the objective of demonstrating the legal implications, advantages and disadvantages of utilizing what has been called the BACEN JUD system of "penhora on-line" (online attachment). Created by means of an agreement of technical-institutional cooperation between Banco Central do Brasil (Central Bank of Brazil) and the Judicial Department, this mechanism arose as a form of modern technological solution in the fight against the lack of being able to enforce the law. The reason for this is that "penhora online" is quick and effective in freezing debtor accounts, which can happen by a simple electronic request to the Financial Institutions. The theory behind this is that the debtor would have greater trouble in eschewing responsibility, thus eliminating default payments and making the executive process more effective. However, despite "penhora online" being considered an invaluable tool to streamline the executive process, it should undergo some adjustments in its procedures because if not it will be violating innumerous rights of the debtor as well as violating various judicial norms and principles that govern life in society.
O presente trabalho tem por objetivo demonstrar as implicações jurídicas, vantagens e desvantagens da utilização do chamado sistema BACEN JUD de penhora on-line. Criado por meio de um convênio de cooperação técnico-institucional, firmado entre o Banco Central do Brasil e o Poder Judiciário, o mecanismo surgiu como forma de solução tecnológica moderna no combate a falta de efetividade no processo de execução. Isso porque a penhora on-line é rápida e eficiente no bloqueio de contas do devedor, o que se dá por meio de simples solicitação eletrônica às Instituições Financeiras. Com isso, em tese, se evitaria a fuga à responsabilidade do devedor, eliminando-se o mau pagador e, via de conseqüência, dando-se efetividade ao processo executivo. Entretanto, apesar da penhora on-line ser considerada uma ferramenta de inestimável valia para agregar efetividade ao processo executivo, deve sofrer alguns ajustes em seu procedimento, pois, caso contrário, estará violando inúmeros direitos do devedor, ofendendo diversas normas e princípios jurídicos que regem a vida em sociedade. |
