O direito autoral numa perspectiva dos direitos fundamentais: a limitação do excesso de titularidade por meio do direito da concorrência e do consumidor

Abstract

As limitações do Direito Autoral constituem na atualidade uma das maiores preocupações dos estudiosos do Direito, tendo em vista que o advento da Sociedade da Informação propiciou uma situação paradoxal na relação entre os autores e/ou titulares de Direito Autoral e os usuários/consumidores. Os primeiros com a ânsia de exercerem ao máximo o Direito exclusivo de exploração patrimonial das obras e, os segundos, na busca do acesso ao conhecimento. A tendência é normatizar nas leis autorais uma redução dos limites em franco desfavor dos usuários das obras, mas ao lado desta tendência observa-se a limitação do Direito Autoral por outros direitos de mesma grandeza, como é o caso da cultura, da concorrência e do consumidor. A existência destas limitações extrínsecas parecem demonstrar que o Direito Autoral está atravessando um momento peculiar dentro de toda a sua existência jurídica, tendo como motor propulsor, desta época, o exercício do exclusivo pelos autores e, em especial, pelos titulares de Direito que buscam cada vez mais limitar os usuários o acesso livre às obras, chegando, por vezes, a tentar impedir o uso total e transformativo da obra. O Direito da Concorrência e do consumidor dentro deste contexto estão atuando como limitadores do Direito Autoral para coibir o excesso de titularidades.

Limitations of Copyright is currently a major concern for scholars of law, since the advent of the Information Society gave a paradoxical situation in the relationship between authors and / or copyright holders and users/consumers. The first with the desire to exercise the exclusive right to the maximum operating assets of the works and the latter in search of access to knowledge characterized this paradox of the information society in the Copyright, that brings to light the problem of excessive title. The trend is standardize copyright laws in reducing the limits on free detriment of users of works, but next to this trend there is a limitation of the copyright rights of others of the same magnitude as in the case of information, competition and consumer. These intrinsic and extrinsic limitations appear to demonstrate that the Copyright is experiencing a unique moment in all its legal existence, with the engine propelling this season only by the exercise of the authors and, in particular, by the holders of rights that seek increasingly limited users free access to works, even, sometimes, trying to prevent the full use of the work, preventing the use of processed. Competition law in this context is acting as a limiting factor of the Copyright bringing the discussion about the title and over-the changes that the Copyright is suffering in postmodernity.
