| Resumen: | These present researche, linked to the research line in Criminology and Social Control, is treated of a Study of Case, accomplished through quanti-qualitative methodology of documental analysis, on a municipal shelter that welcomes adolescents between 12 and 17 years under Measure of Protection of Sheltering in the Municipal Shelter Ingá Brita (AMIB). The researche treats of a study that looks for to analyze, in the specificity of the protection politics to the childhood and brazilian youth, a small part of the reality of Porto Alegre, relating the protection measures and the applied partner-educational measures for the competent authorities. It was looked for to describe the characteristics of the application of sheltering measure in AMIB, in way to characterize them, as well as to detect the possible incoherence between the effective legislation and the social practices of the phenomenon male sheltering of adolescents in Porto Alegre, to investigate the contradictions supposedly existent in the abrigamento measures made in AMIB, as well as the effects that these contradictions can come to exercise in the adolescents with respect to the identification with the crime and the misdemeanor. The general objective of the research was to investigate the possible nature of social control and surveillance, besides the possible effects of stigmatization of the application of measure of sheltering protection to male adolescents, between 12 and 17 years, accomplished in the last two years, in the Municipal Shelter Ingá Brita. The specific objectives were centered in the investigation of the possible discrepancy among the reasons alleged by the authorities and the appraised reasons for the technicians of the Net of Municipal Own Shelters, after the adolescent's entrance. Besides, it was looked for the verification of the increase or decrease of the involvement incidence in situations of conflicts with the sheltered adolescents' law, after the entrance in AMIB. The data point a low effective impact of the modifications introduced by the Child's Statute and of the Adolescent in the routines of the organs of the system of warranty of children rights, appearing for the maintenance of practices of “stamp menorista”, mainly when related to adolescents involved in law breaker actions and conduct problems.
A presente pesquisa, vinculada à linha de pesquisa em Criminologia e Controle Social do Programa de Pós-Graduação em Ciências Criminais da Faculdade de Ciências Jurídicas e Sociais da PUCRS constitui-se em um Estudo de Caso, realizado através de metodologia quanti-qualitativa de análise documental, sobre um abrigo municipal que acolhe adolescentes entre 12 e 17 anos sob Medida de Proteção de Abrigamento, o Abrigo Municipal Ingá Brita (AMIB). O estudo busca analisar, na especificidade das políticas públicas governamentais de proteção à infância e juventude brasileira, uma pequena parte da realidade de Porto Alegre, relacionando as medidas de proteção e as medidas sócio-educativas aplicadas pelas autoridades competentes. Buscou-se descrever as características da aplicação de medida de proteção de abrigo, no AMIB, de forma a caracterizá-las, bem como detectar as possíveis incoerências entre a legislação vigente e as práticas sociais do fenômeno de acolhimento institucional de adolescentes do sexo masculino em Porto Alegre, investigar as contradições supostamente existentes nas medidas de abrigamento efetuadas no AMIB, bem como os efeitos que estas contradições podem vir a exercer nos adolescentes no que tange à identificação com o crime e a contravenção.O objetivo geral da pesquisa foi investigar a possível natureza de controle social e vigilância, além dos possíveis efeitos de estigmatização da aplicação de medida de proteção de abrigo a adolescentes do sexo masculino, entre 12 e 17 anos, realizadas durante dois anos, no Abrigo Municipal Ingá Brita. Os objetivos específicos centraram-se na investigação da possível discrepância entre os motivos alegados pelas autoridades abrigantes (Juizado da Infância e Juventude e Conselho Tutelar) e os motivos avaliados pelos técnicos da Rede de Abrigagem Própria Municipal, após ingresso do adolescente. Além disso, buscou-se a verificação do aumento ou diminuição da incidência de envolvimento em situações de conflitos com a lei dos adolescentes abrigados, após o ingresso no AMIB. Os dados indicam um baixo impacto efetivo das modificações introduzidas pelo Estatuto da Criança e do Adolescente nas rotinas dos órgãos do sistema de garantia de direitos infanto-juvenis, apontando para a manutenção de práticas de cunho menorista, principalmente quando relacionadas a adolescentes envolvidos em atos infracionais e problemas de conduta. |
