| Resumo: | O trabalho pericial em locais de morte foca-se, primordialmente, no reconhecimento, estudo e preservação de vestígios. A partir de tal análise, busca-se compreender a dinâmica dos fatos, com o intuito de fornecer subsídios que permitam definir agressores e modos de atuação, embasando a investigação criminal. Por tradição, o foco da atividade pericial no local de morte direciona-se ao vestígio físico ou material. No entanto, ao conceber que o fenômeno da violência tem sua origem ligada a variados fatores, como os biológicos, psicológicos, neurológicos, sociais e econômicos, entende-se que a expressão deste fenômeno também ocorra de maneira múltipla. Considerando tal premissa, parte-se como hipótese, nesta pesquisa, que pode haver um aspecto psíquico vinculado aos elementos da cena de morte violenta e que a análise desse material pode qualificar o trabalho pericial, trazendo benefícios à investigação. Dessa forma, coloca-se como problema o seguinte questionamento: de que forma se dá a expressão dos conteúdos psíquicos de vestígios em locais de morte violenta? Com base nesse pressuposto e, trilhando pela interdisciplinaridade, apresenta-se pesquisa bibliográfica sobre os temas da atividade pericial, da violência e dos vestígios vinculados aos locais de morte, elaborando o construto do conteúdo psíquico. O estudo conta ainda com referencial bibliográfico sobre três tipos de ocorrências que se mostram mais propícias à presença de aspectos psíquicos: os suicídios, os crimes com motivação passional e os crimes relacionados ao tráfico de drogas. São apresentados casos atendidos pelo Departamento de Criminalística do Instituto-Geral de Perícias do Rio Grande do Sul, vinculados a 21 ocorrências policiais, de modo a realizar articulação entre a pesquisa bibliográfica e a realidade dos atendimentos periciais efetuados em nosso estado, no que se refere à possibilidade de interpretação de conteúdo psíquico de vestígios. Objetivou-se, nesta pesquisa, analisar tal conteúdo, incluindo suas características e o contexto de suas manifestações. Buscou-se, ainda, verificar as similaridades dos conteúdos de acordo com o tipo de fato que ocasionou o atendimento e os elementos possíveis de serem interpretados a partir dos mesmos, como motivações, características de vítimas e/ou agressores, premeditação, etc. A pesquisa realizada indicou a possibilidade de ampliar a análise de vestígios, interpretando também os aspectos psíquicos dos elementos encontrados em locais atendidos pelas equipes periciais. Tal resultado
indica que esta ampliação pode contribuir para o enriquecimento do trabalho pericial e, consequentemente, para a qualidade da investigação criminal.
The forensic work on crime scenes focuses primarily on the recognition, study and preservation of traces. From this analysis, it is sought to understand the dynamics of the facts, with the intention of providing subsidies that allow to define aggressors and ways of acting, supporting the criminal investigation. By tradition, the focus of the expert activity in the crime scene is directed to the physical or material vestige. However, in conceiving that the phenomenon of violence has its origin linked to several factors, such as biological, psychological, neurological, social and economic, it is understood that the expression of this phenomenon also occurs in a multiple way. Thus, it is hypothesized, in this research, that there may be a psychic aspect linked to the elements of the violent death scene and that the analysis of this material can qualify the forensic work, bringing benefits to the investigation. Thus, the problem is the following question: in what way is the expression of vestigial psychics in places of violent death? Based on this assumption, and through interdisciplinarity, a bibliographical research is presented on the subjects of expert activity, violence and vestiges linked to the places of death, elaborating the construct of the psychic content. The study also has a bibliographic reference on three types of occurrences that are more propitious to the presence of psychic aspects: suicides, crimes with passionate motivation and crimes related to drug trafficking. The cases attended by the Instituto-Geral de Perícias Department of Criminalistics, linked to 21 police incidents, are showed in order to articulate the bibliographical research and the reality of the expert witnesses carried out in our state, regarding to the possibility of interpreting the psychic content of evidences. The objective of this research was to analyze such content, including its characteristics and the context of its manifestations. It was also sought to verify the similarities of the contents according to the type of fact that caused the attendance and the possible elements to be interpreted from them, such as motivations, characteristics of victims and / or aggressors, premeditation, etc. The research carried out indicated the possibility of expanding the analysis of evidences, also interpreting the psychic aspects of the elements found in places attended by the expert teams. This result indicates that this increase can contribute to the enrichment of expert work and, consequently, to the quality of criminal investigation. |
